Agreements & terms
These terms and conditions apply to all services of sio-IT: IT help, web design and hosting. They are deliberately short and written in plain language. If your quote or contract says something different, the quote or contract applies. In case of differences with the Dutch version, the Dutch version prevails.
These terms include the following sections:
sio-IT, Kees en Henny de Ruijterstraat 23, 5146 ER Waalwijk, the Netherlands. Chamber of Commerce number 68063628, VAT number NL002428778B21.
You can reach us at info@sio-it.nl, via the contact form on this website or via WhatsApp.
These terms apply to every quote, assignment and agreement between sio-IT and you, both for private individuals (consumers) and for businesses.
Agreements in a quote or a signed contract take precedence over these terms. Terms of the customer only apply if sio-IT agrees to them in writing.
Where something in these terms applies only to consumers or only to businesses, this is stated. These terms never limit the statutory rights of consumers.
Prices for consumers include 21% VAT. Prices for businesses exclude VAT, with the amount including VAT shown alongside.
You receive an invoice by email. The payment term is 7 days, unless the invoice states a different term. You pay online via Mollie (for example iDEAL) using the payment link on the invoice, or by transferring the amount to the account on the invoice.
If an invoice is not paid after the due date, we send a reminder with an extra payment term of 14 days. Only after that may we suspend a service (see Hosting). We only charge collection costs to consumers after a statutory reminder, again with 14 days to pay without costs.
For IT help at home or remotely, you pay for the time we actually spend with you, per quarter of an hour, plus any travel costs. Current rates are on the IT help page. We discuss the expected costs in advance.
We do our best to solve the problem, but cannot always guarantee a result, for example with defective hardware or problems at another party. In that case you still pay for the time spent.
Where possible, make a backup of important files beforehand. We work carefully, but cannot be responsible for data without a backup. Required licences, subscriptions and parts are at your expense, after consultation.
For a website we first make a quote with what will be built, the price and the planning. We only do extra work outside the quote after your approval, at the agreed price.
You supply texts, photos and logos and make sure you are allowed to use them. After full payment you may use the delivered website without limitation for your own business or purpose.
After delivery you have 14 days to report errors; we fix those free of charge. Later changes and maintenance are done on request.
For hosting you sign a hosting contract online in the customer dashboard. It states the package, the price and the details. The contract takes precedence over these terms.
Term: the contract runs for 12 months from activation. After that, for businesses it renews for 1 year each time and can be cancelled up to 1 month before the end. For consumers the contract continues indefinitely after the first year and can be cancelled monthly with 1 month's notice. You can cancel by email or in the dashboard.
We invoice in advance. We announce a price change after the first year at least 1 month in advance; you may then cancel as of the date of the change.
Included are an SSL certificate, daily backups (restored on request) and support by email. A domain name is not included; you arrange and pay for it yourself and we connect it. If storage is full, we let you know and within 14 days you choose a larger package or clean up.
If an invoice remains unpaid after the reminder with 14 days' extra term, we may pause the hosting until payment is received. After the contract ends we keep the website and email for another 30 days so you can request an export. After that they are deleted.
If you as a consumer conclude an agreement with us online or at a distance, such as a hosting contract, you have a cooling-off period of 14 days. During that period you can dissolve the agreement without giving a reason by letting us know by email. You receive the model withdrawal form with the contract.
If you explicitly ask us to start within the cooling-off period, you only pay for the part already delivered if you withdraw. If a service has been fully performed within the cooling-off period at your request, such as a completed IT help appointment, the cooling-off period for that service lapses.
We carry out our work carefully. If something still goes wrong through our fault, report it as soon as possible so we can fix it.
For businesses, our liability per contract year is limited to the amount you paid for the service concerned in the preceding 12 months, with a minimum of € 500. This limitation does not apply in case of intent or deliberate recklessness. We are not liable for indirect damage, such as lost revenue.
For consumers, liability applies as provided by law; we do not limit it.
How we handle personal data is described in our privacy policy. For business hosting with websites and mailboxes we process data on your behalf; for that you sign a data processing agreement with the contract.
Your data is processed within the European Economic Area. We report a data breach affecting your data within 48 hours of discovering it.
If you have a complaint, email it to info@sio-it.nl. You will receive a substantive response within 14 days. If we cannot resolve it together, you can submit the dispute to the competent court.
Dutch law applies to all agreements with sio-IT. We may change these terms; for running contracts, changes only apply after we have announced them at least 1 month in advance.
Is something in these terms unclear, or would you like to receive an earlier version? Let us know.
